And that’s where things went wrong. In February 2019, New York City announced that it was going to implement a ban on edible products containing CBD. In other words, using CBD as a food additive became prohibited.


The ban has now officially gone into effect, and business owners in the Big Apple ceased selling CBD in October 2019. Selling CBD ingestibles can now come with a $600 fine. It’s kind of a ridiculous ban that doesn’t really stop much; one coffee shop, for example, now sells a separate shot of CBD that the customer can add to their coffee by hand. This is allowed, but selling pre-infused coffee is not. See the confusion?


Plus, members of the City Council have protested against the ban, because it was never actually authorized by the Council. It was instead the Department of Health which implemented the ban, and the Council had no say in the matter. This mismatch in practices is causing a lot of confusion.


The ban could be reversed fairly soon, but right now CBD edibles are not permitted in New York City. Elsewhere, they are fine. Until we get word that things have changed, it is best to avoid these products in New York.
